Have you received a pay less notice (sometimes spelt payless notice) and wondered if it was valid and how it was going to effect your cash flow, or what it all meant, or how you dispute? Or even what you should do?

In very general terms, if an employer (that is your employer, i.e. the one responsible for paying for your work and could be The Client, Main Contractor, Specialist Sub Contractor etc) wishes to pay you less than your application, then before the money is due, they have to issue you with a Pay Less Notice, advising you that they are not paying the application in full and giving the reasons why and some details.

Depending on the form of contract or agreement, there are very specific requirements for a Pay Less notice (used to be called withholding notice) to be valid. If it is not valid then of course you can dispute it, and if required go to adjudication for the full value of your application/invoice. This can often be quicker for cashflow than disputing a Final Account. Once the money has been awarded and in your account the employer then has to claim it back from you.

If you do not receive payment in full of your application or invoice and you have not received a pay less notice at all, then you are entitled to payment in full (if only in the interim) and we can help you get that payment.
